Confirmation of Article 4 Direction in Old Oak and Park Royal

CONFIRMATION OF REMOVAL OF PERMITTED DEVELOPMENT RIGHTS IN THE OLD OAK AND PARK ROYAL STRATEGIC INDUSTRIAL LOCATION

 

On 21 September 2017 Old Oak and Park Royal Development Corporation (OPDC) announced that they were withdrawing some permitted development rights in the Old Oak and Park Royal area. The ‘Article 4 Direction’ has been confirmed and came into force on 22 September 2017.

What are permitted development rights?
Permitted development rights allow property owners to undertake certain works or change the use of buildings without the need to apply for planning permission, depending on the circumstances of the building and subject to a number of criteria being satisfied.

Which permitted development rights are being removed?
The permitted development rights that are to be removed are:

  • Changes of use from offices to houses or flats; and
  • Changes of use from storage/distribution uses to houses or flats.

 

The Direction applies to land in the Old Oak and Park Royal Strategic Industrial Location which is shown edged and shaded in purple and removes permitted development rights for development described in the Schedule below. The effect of the Direction is that such development shall not be carried out within the affected area unless planning permission is granted on an application made to the OPDC under Part III of the Town and Country Planning Act 1990 (as amended).

SCHEDULE

Development consisting of a change of use of a building and any land within its curtilage:

  1. a) to a use falling within Class C3 (dwellinghouses) of the Schedule to the Town and Country Planning (Use Classes) Order 1987 (as amended) from a use falling within Class B1(a) (offices) of that Schedule being development comprised within Class O of Part 3 of Schedule 2 to the Order and not being development comprised within any other class; and
  1. b) to a use falling within Class C3 (dwellinghouses) of the Schedule to the Town and Country Planning (Use Classes) Order 1987 (as amended) from a use falling within Class B8 (storage or distributions centre) of that Schedule being development comprised within Class P of Part 3 of Schedule 2 to the Order and not being development comprised within any other class.

In other words, from 22 September 2017, the change of use of buildings currently in office or storage and distribution use to either houses or flats in the Old Oak and Park Royal Strategic Industrial Location will require planning permission.
